The website www.advistra.in (called as “Advistra” “Platform” “website” "we" “our” or "us") is owned and operated by Advistra Consulting Private Limited, a company incorporated in India under the Companies Act, 2013 (“Company”). The Company is engaged in the business of human resource consulting and allied services including recruitment, staffing, placement, HR outsourcing, payroll, performance and change management, organizational design, HR audits, training and skill development, career advisory, and workforce solutions; to establish and operate training and educational institutions; to provide marketing and digital marketing services including brand management and market research; to develop, operate, and license digital and technology platforms for delivering such services; and to conduct market, feasibility, compensation, and remuneration studies, along with lawful advisory services in India and/or abroad and other related services (“Services”).
These Terms and Conditions applies to everyone regardless of whether you use a computer, mobile phone, tablet, or television or any other media or computer resource to access our Services. It also applies to those who register on our website/applications in connection with use of our services, or whose data we otherwise receive in connection with our services. If you do not agree to any of these terms, please do not use the Services provided by the Company.
It is mandatory for all Users of the Site to have read carefully, fully understood and be in total agreement with the below-mentioned Terms before they proceed to use any of the services of the Site ("Services"). The Services are available only to those individuals, firms or companies who can form legally binding contracts under the Indian laws. Advistra Consulting Private Limited may amend these Terms of Use at any time by posting the amended version on this site. Such amended version shall automatically be effective upon its posting on this site.
These Terms of Use are an electronic record under the Information Technology Act, 2000 and the rules made thereunder as applicable and the amended provisions pertaining to electronic records in various statutes under applicable Indian laws. This electronic record is generated by a computer system and does not require any physical or digital signatures.
For the purpose of these Terms of Use, "we", "us" and "our" mean the Advistra Consulting Private Limited ("Company") and "you", "your" and "user" means any person who accesses or uses or registers on our website, www.advistra.in ("Website") and avails our Services.

Unless the context otherwise requires, the terms listed below when used below shall have the meanings attached to them and these terms shall be interpreted accordingly. The terms listed below as used in hereunder may be identified by the capitalization of the first letter of each principal word thereof. In addition to the terms defined below, certain other capitalized terms are defined elsewhere in this document and whenever such terms are used in this document, they shall have their respective defined meanings, unless the context, expressly or by necessary implication, require otherwise.

Account Information: refers to a user identification code, password one-time password (OTP) or any other information provided to the User as part of the Platform’s security and authentication procedures.

Agreement: means and includes the Terms and Conditions, Privacy Policy and any other such terms and conditions that may be mutually agreed upon between the Company and the User in relation to the Services;

Applicable Law: means and includes any statute, law, regulation, sub-ordinate legislation, ordinance, rule, judgment, rule of law, order (interim or final), writ, decree, clearance, Authorizations, approval, directive, circular guideline, policy, requirement, code of practice or guidance note, or other governmental, regulatory, statutory, administrative restriction or any similar form of decision, or determination by, or any interpretation or administration of any of the foregoing by, any statutory or regulatory authority or government agency or any other authority, in each case having jurisdiction over the subject matter of this Agreement;

Company: means Advistra Consulting Private Limited, a company incorporated under the Companies Act, 2013, including its directors, officers, employees, and authorised representatives.;

Confidential Information: means and includes all information that is not in the public domain, in spoken, printed, electronic or any other form or medium, relating directly or indirectly to, the assets, business processes, practices, methods, policies, subscription plans, publications, documents, research, operations, services, strategies, techniques, agreements, contracts, terms of agreements, transactions, potential transactions, negotiations, pending negotiations, know-how, trade secrets, computer programs, computer software, applications, operating systems, software design, web design, work-in-process, databases, manuals, records and reports, articles, systems, material, sources of material, supplier identity and information, vendor identity and information, User identity and information, financial information, results, accounting information, accounting records, legal information, marketing information, advertising information, pricing information, credit information, developments, internal controls, security procedures, graphics, drawings, sketches, sales information, costs, formulae, product plans, designs, ideas, inventions, original works of authorship, discoveries and specifications, of the Company and/or affiliates or their respective businesses, or any existing or prospective customer, supplier, investor or other associated third party, or of any other person or entity that has entrusted information to the Company in confidence;

Content: means and includes any information all data and information on the Site;

Employer: means any individual, firm, company, institution, or organization that posts job opportunities, internships, freelance roles, or hiring-related information on the Platform.

Intellectual Property: means and includes patents, inventions, know how, trade secrets, trademarks, service marks, designs, tools, devices, models, methods, procedures, processes, systems, principles, algorithms, works of authorship, flowcharts, drawings, and other confidential and proprietary information, data, documents, instruction manuals, records, memoranda, notes, user guides, ideas, concepts, information, materials, discoveries, developments, and other copyrightable works, and techniques in either printed or machine-readable form, whether or not copyrightable or patentable, each of which is not in the public domain or would by its very nature fall within public domain;

Intellectual Property Rights: mean and include (a) all right, title, and interest under including but not limited to patent, trademark, copyright under the Patents Act, 1970, Trademarks Act, 1999 and Copyright Act, 1957 respectively; any statute or under common law including patent rights; copyrights including moral rights; and any similar rights in respect of Intellectual Property, anywhere in the world, whether negotiable or not; (b) any licenses, permissions and grants in connection therewith; (c) applications for any of the foregoing and the right to apply for them in any part of the world; (d) right to obtain and hold appropriate registrations in Intellectual Property; (e) all extensions and renewals thereof; (f) causes of action in the past, present or future, related thereto including the rights to damages and profits, due or accrued, arising out of past, present or future infringements or violations thereof and the right to sue for and recover the same; (g) any Confidential Information;

Platform / Site: means the website www.advistra.in owned, operated, and managed by the Company, including all related features, tools, and services.

Prohibited Conduct: means and includes any use of the Services by a User that violates this Agreement or any Applicable Law, including but not limited to: (i) infringement or misappropriation of the Company’s or any third party’s Intellectual Property Rights; (ii) violation of or abetment of violation of third-party rights; (iii) attempting to gain, or assisting another person to gain, unauthorized access to the Platform, Accounts, systems, or networks; (iv) framing, mirroring, scraping, or creating unauthorized links to the Platform or its Content; (v) sending spam, unsolicited, deceptive, or duplicative communications; (vi) uploading, posting, transmitting, or storing any content that is unlawful, obscene, defamatory, threatening, abusive, misleading, discriminatory, harmful to minors, or violative of privacy or data protection laws; (vii) impersonating any person or entity, misrepresenting affiliation, or accessing another User’s Account without authorization; or (viii) modifying, copying, reverse-engineering, or creating derivative works from the Services or Platform.

User: means any person or legal entity that accesses, browses, registers on, or uses the Platform, for whatever purpose, regardless of whether said User has registered with www.advistra.in as a registered User or whether said User is a paying User for a specific service provided by www.advistra.in. A User includes the person using this Site and any legal entity which may be represented by such person under actual or apparent authority;

Un-Authorized User: means any person who does not have a legal or a contractual right to access the services, but does so, will fall within the definition of an 'unauthorized User' and will be subject to the terms and conditions, and expressly so with respect to respecting the intellectual property rights of the provider, and abiding by licensing terms and conditions;

GENERAL INTERPRETATION
In this Agreement, except to the extent that the context otherwise requires:

References to any statute, enactment, ordinance, or other Applicable Law shall be deemed to include such statute, enactment, ordinance, or law as amended, re-enacted, supplemented, or replaced from time to time, and shall include all rules, regulations, notifications, and instruments issued thereunder;

References to Clauses, Schedules, or Annexures shall mean the clauses, schedules, or annexures of this Agreement, and all such Schedules and Annexures shall form an integral part of this Agreement.

Headings and titles are inserted for convenience only and shall not affect the interpretation or construction of this Agreement.

OVERRIDING EFFECT
In the context of this Agreement:

The Company and the Users agree that their respective rights, obligations, and liabilities shall be interpreted, performed, and governed strictly in accordance with the terms and conditions of this Agreement.

This Agreement shall govern the contractual relationship between the Company and the Users in relation to the Services, and, subject to Applicable Law, shall have overriding effect notwithstanding anything inconsistent contained in any other document, communication, or understanding, whether oral or written.

ACCESS TO THE SITE

First-time Users may access the Platform for limited, preliminary browsing without creating an Account.

To access specific features and avail the Services, the User shall be required to provide accurate User information, upload Content (where applicable), and create a registered Account on the Platform.

The Company may verify a User’s Account through one-time password (OTP) or such other authentication mechanism as it may deem appropriate. A mobile number and/or email address may be used only once to create an Account, and Users are prohibited from creating multiple Accounts. The Company reserves the right to conduct verification checks to detect duplicate or fraudulent Accounts and to take appropriate action, including suspension or termination.

The User agrees to cooperate with the Company and its authorized personnel for verification, security, and access-related requirements in connection with the User’s use of the Platform.

SUBSCRIPTION PLANS

The Company offers various subscription-based and/or paid Services on the Platform, which Users may subscribe to based on their requirements, upon payment of the applicable fees as displayed on the Platform.

Unless expressly stated otherwise on the Platform or under a specific plan, all subscription fees paid by the User are non-refundable. Any refund or money-back eligibility shall be strictly governed by the terms of the specific plan as disclosed on the Platform.

The Company reserves the right to revise, modify, or discontinue the pricing, features, or terms of any subscription plan at any time. Any such revision shall not affect fees already paid for the current subscription period but shall apply to renewals or new subscriptions. The revised fees shall be communicated to the User through the Platform or other appropriate means.

USER'S OBLIGATIONS

The User agrees and acknowledges that they are solely responsible for the accuracy, completeness, and truthfulness of all registration data, profile details, and other information provided to the Company while creating an Account or subscribing to the Services, and shall ensure that no information submitted is false, misleading, fraudulent, or manipulated.

The User represents and warrants that they have obtained all necessary rights, consents, and authorizations before uploading, posting, or sharing any Content on the Platform, including but not limited to resumes, job postings, descriptions, images, videos, training materials, or contact information.

The Company may, at its discretion, require Users to submit supporting documents or information to verify claims, qualifications, employment details, training credentials, or other information submitted on the Platform.

The User shall be responsible for arranging and maintaining all equipment, devices, internet connectivity, and software required to access and use the Services.

The User agrees to comply with all notices, guidelines, and instructions issued by the Company from time to time in relation to the use of the Platform and Services.

The User shall be solely responsible for all information retrieved, stored, uploaded, transmitted, or shared by them through the Platform.

The User shall maintain strict confidentiality of Account credentials, including username, password, and authentication details, and shall be responsible for all activities carried out through their Account.

The User shall immediately notify the Company of any unauthorized use of their Account or any breach of security of which they become aware.

The User agrees to pay all applicable subscription fees or charges in a timely manner, as notified by the Company from time to time.

The User shall take all reasonable security measures, including periodic password changes, to protect their Account and data.
-
The User may discontinue use of the Platform and request deletion of their Account by following the account removal or deactivation procedure made available on the Platform, subject to applicable law and the Company’s data retention policies.

USER ACCOUNT
Upon registration on www.advistra.in, an Account shall be created for the User. Access to the Account may be enabled through one-time password (OTP)–based authentication, password-based login, and/or such other secure authentication mechanisms as may be implemented by the Company from time to time.
If the User accesses the Platform using a third-party login (such as Google, LinkedIn, or other supported services), the credentials of such third-party account, as applicable, shall be deemed to constitute the User’s Account Information. All login credentials, including OTPs, passwords, and authentication details, shall be treated as confidential and shall not be shared with any third party.
Any access to or use of the Platform through the User’s Account shall be deemed to be access or use by the User, and the User shall be solely responsible for all activities carried out through their Account, whether or not expressly authorized by the User.
Subject to Applicable Law, the User agrees to be liable for all use of their Account. If the User knows or reasonably suspects any unauthorized access to their Account or any breach of security, the User shall promptly notify the Company at support@advistra.in.
The Company reserves the right to suspend, restrict, or disable the User’s Account or any part thereof at any time if, in its reasonable opinion, the User has breached these Terms or such action is necessary to protect the security or integrity of the Platform.
PRIVACY
In the event that you choose to create an Account on, you may be required to provide certain personal information, including but not limited to your name, contact details, email address, mobile number, login credentials, and such other information as may be necessary to provide the Services.
Our Privacy Policy, available at our website www.advistra.in describes how we collect, use, store, disclose, and protect personal information provided by you or collected through your use of the Platform. By accessing or using the Platform and Services, you expressly consent to the collection, processing, and use of your personal information in accordance with the Privacy Policy, including, where applicable, sharing such information with third-party service providers, partners, or affiliates solely for the purposes stated therein and in compliance with Applicable Law.

COPYRIGHT, TRADEMARKS AND LICENSES
All content, design elements, software, text, graphics, logos, trademarks, service marks, and other materials available on the Platform are protected by applicable copyright, trademark, and intellectual property laws.
The Platform is owned and operated by Advistra Consulting Private Limited. Except for User-generated Content, all intellectual property rights in the Platform and Services vest with the Company or its licensors. Ownership of User-generated Content remains with the respective User or creator.
The Company is the owner or authorized licensee of all copyrights, trademarks, service marks, and other intellectual property appearing on the Platform, and all such rights are expressly reserved.
Users shall not copy, modify, reproduce, republish, upload, post, transmit, distribute, or commercially exploit any material from the Platform, including text, graphics, code, software, or design elements, without prior written consent of the Company. Users may view, print, or download limited portions of the Platform solely for their personal, non-commercial use, provided that all copyright and proprietary notices are retained.
By submitting, uploading, or posting any Content on the Platform, the User grants the Company a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, host, reproduce, distribute, transmit, display, adapt, and create derivative works from such Content for the purpose of operating, promoting, and improving the Platform and Services, in any media now known or hereafter developed.
All publications, products, content, and services referenced on the Platform, and all logos, brands, trademarks, and registered marks appearing on www.advistra.in or the Advistra mobile application (collectively, “Marks”), are the property of the Company or its licensors. No rights in such Marks are granted to Users except as expressly provided under this Agreement. All rights not expressly granted are reserved.

PUBLISH CONTENT/ INFORMATION
Users shall not host, display, upload, modify, publish, transmit, update, or share any information or engage in any conduct that:

Is abusive, harassing, threatening, defamatory, misleading, fraudulent, hateful, disparaging, or otherwise violative of the legal rights, privacy, or dignity of any person or entity;

Is obscene, pornographic, paedophilic, indecent, vulgar, or unlawful, including content that violates the Indecent Representation of Women (Prohibition) Act, 1986, or is harmful to minors;

Promotes or relates to illegal activities including money laundering, gambling, terrorism, or any activity prohibited under Applicable Law;
-
Impersonates any person or entity, falsely represents affiliation, or misleads others regarding identity, qualifications, employment opportunities, or credentials;
-
Infringes or violates any copyright, trademark, patent, trade secret, or other intellectual property or proprietary rights of any third party;
-
Contains viruses, malware, corrupted files, or any other programs or code designed to disrupt, damage, or limit the functionality of the Platform, systems, networks, or other users’ devices;

Interferes with, disrupts, damages, or gains unauthorized access to the Platform, servers, networks, accounts, security features, authentication mechanisms, or related infrastructure, including probing, scanning, scraping, or testing vulnerabilities;

Collects, harvests, stores, or misuses personal data or information of other Users without lawful authority or consent;

Downloads, copies, or distributes content that the User knows or reasonably should know cannot be lawfully shared in such manner;

Uses the Platform or any Content for any unlawful purpose, to solicit illegal activity, or to violate these Terms, any applicable policies, or Applicable Law;

Publishes false, inaccurate, deceptive, or misleading information, including fake job postings, fraudulent opportunities, or misrepresentation of training or placement outcomes;

Threatens the unity, integrity, security, sovereignty, or public order of India, harms friendly relations with foreign states, or incites the commission of any cognizable offence;
-
Creates legal liability for the Company or causes loss of services from internet service providers, hosting providers, payment partners, or other vendors.
Any violation of this section may result in removal of content, suspension or termination of the User’s Account, and initiation of legal action, without prejudice to any other rights or remedies available to the Company under Applicable Law.

PROHIBITED USE

The User shall not put to use the Services offered by the Site in any manner that impairs, disrupts, damages, or adversely affects the functioning, security, or integrity of the Platform, or that is in non-compliance with any laws and regulations.

The User will not allow any person other than the authorised User to access or use the Services through their Account.

The User shall use the Service only for the purpose for which it is subscribed or made available, and in accordance with this Agreement.

The User will comply with all applicable laws and shall not contravene any applicable law of India relating to the Services, including any regulation made pursuant thereto.

The User shall not to use the Service for any unlawful purpose including without limitation criminal purposes.

In the event of any violation of the provisions relating to prohibited content, prohibited conduct, or prohibited use under this Agreement, the Company reserves the right, without prior notice and at its sole discretion, to remove or disable access to any content, issue warnings, suspend or terminate the User’s Account, and restrict access to the Services.
In addition to the foregoing, the Company shall be entitled to seek indemnification and pursue any legal, equitable, or remedial action available under Applicable Law to recover losses, damages, costs, or harm to reputation or goodwill suffered as a result of such violation by the User.

DISCLAIMER
The Users acknowledge and agree that is an online platform operated by that facilitates interaction between Users for purposes including job listings, recruitment, career advisory, and training-related services. The Company acts solely as an intermediary and does not guarantee employment, interviews, placements, training outcomes, or accuracy of User-generated information.
The Platform and Services are provided on an basis. The Company makes no representations or warranties, express or implied, regarding the completeness, accuracy, reliability, suitability, or availability of the Platform, Services, job listings, training content, or related information. Any reliance placed on such information is strictly at the User’s own risk.
To the maximum extent permitted by Applicable Law, the Company shall not be liable for any loss or damage of any kind, including without limitation indirect, incidental, consequential, or special damages, loss of data, loss of profits, or business interruption, arising out of or in connection with the use of, or inability to use, the Platform or Services.
While reasonable efforts are made to ensure uninterrupted access to the Platform, the Company shall not be responsible or liable for temporary unavailability, delays, errors, or interruptions due to technical issues, maintenance, system failures, internet outages, or events beyond the Company’s reasonable control.
The Company makes no warranty that:

The service will be uninterrupted, persistent, timely, secure, or error-free.

The results that may be obtained from the use of this service will be accurate or reliable.

The quality of any products, services, information, or other material purchased or obtained by you through the use of the service will meet your expectations.
Further, we do not assume any responsibility or liability for:

Access to and use of such third-party websites shall be at the User’s own risk and subject to the terms and policies of those third parties.

OTHER TERMS AND CONDITIONS

Force Majeure:
The Company will not be deemed in default hereunder or held responsible for any cessation, interruption or delay in the performance of its obligations hereunder due to earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, epidemic, pandemic or boycott.

Cessation of Operation:
The Company may at any time, in its sole discretion and without advance notice to you, cease operation of the platform and distribution of the Products/ services.

Governing Law & Jurisdiction:
This Platform originates from Gurugram, Haryana. This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
Subject to Applicable Law, the courts having exclusive jurisdiction at Gurugram, Haryana shall have jurisdiction over any dispute, claim, or proceeding arising out of or in connection with this Agreement, the Platform, or the Services.
By accessing or using the Platform, the User expressly consents to the jurisdiction and venue of such courts.

Statute of Limitation:
You agree that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Website or Products or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Domestic Use:
The Company makes no representation that the Website or Products are appropriate or available for use in locations outside India. Users who access the Website from outside India do so at their own risk and initiative and must bear all responsibility for compliance with any applicable local laws.

Assignment:
You may not assign your rights and obligations under this Agreement to anyone. The Company may assign its rights and obligations under this Agreement in its sole discretion and without advance notice to you.

Limitation of Liability
To the maximum extent permitted under Applicable Law, the total aggregate liability of the Company under this Agreement, or in connection with anything done or omitted to be done by the Company in relation to the Platform or the Services, shall be limited to the 10 % of the fees actually paid by the User to the Company for the specific Service in respect of which such liability arises.

Indemnity
The User agrees to indemnify, defend, and hold harmless Advistra Consulting Private Limited, its directors, officers, employees, agents, and affiliates, at all times, from and against any and all losses, damages, liabilities, costs, expenses, claims, demands, actions, or proceedings (including reasonable attorneys’ fees) incurred or suffered, whether directly or indirectly, arising out of or in connection with:
(a) breach of any terms of this Agreement;
(b) third party claims arising from an infringement or alleged infringement of such third party’s Intellectual Property;
(c) claims made by any Government Authority due to the User’s violation of Applicable Law; or
(d) actual or alleged gross negligence or willful misconduct in connection with the User’s use of the Services or this Agreement.
(e) a fraudulent act committed by a User which results in loss or damage, suffered or incurred by any other User or by any third party.

User Grievance
Any User grievance relating to discrepancies, misuse, or unauthorized handling of information or Services provided by the Company may be addressed to the Grievance Officer appointed by Advistra Consulting Private Limited, whose contact details shall be made available on the Platform.

The Grievance Officer shall acknowledge and make reasonable efforts to resolve such grievance within thirty (30) days from the date of receipt of the grievance, in accordance with Applicable Law.

We will try to respond within 72 hours of receiving the request.

Amendment

The Company shall change, update or modify this Agreement, in whole or in part, without any prior notice to the User, provided, however, that, a notification of such change, updation or modification will be made available on the Site.

The User’s uninterrupted and continued usage of the Services and the Site shall be deemed as acknowledgment and acceptance of the changes, updates or modifications to the Agreement.
